In Germany, the principle of the rule of law makes speedy prosecution a fundamental objective.1 For this reason, the accused must be informed of the charge within a reasonable time and be questioned within a reasonable time.2 In particular, the legislation requires rapid decisions in the case of provisional arrests. The reasonable time starts when the suspect becomes aware of the investigation and ends when the final decision is taken.3

German case law increasingly emphasises the importance of fair trial, which is approached primarily from the perspective of the rights of the debtor. According to this principle, everyone has the right to be heard by the court under normal conditions, and everyone concerned must be given the opportunity to make statements, observations and motions on the charges against him or her. These statements should be noted and considered by the court. 4
