8.8.3. Prohibitions on evidence relating to the testimony of the accused

  • is not obliged to make a statement, or may refuse to make a statement or to answer certain questions at any time during the questioning;1
  • if deciding to make a statement, what is said or provided may be used as evidence.2

The charge sheet must be communicated to the accused person at the time of the first questioning during the investigation and during the first and second instance court proceedings.3 The charge shall be recorded in the minutes, together with the accused’s response to the charge. Failure to record the charge and the reply to the warning shall, as a general rule, result in the statement of the accused not being taken into account as evidence.4

A statement made by the accused as a witness in a previous case or in another case may be used as evidence if the testimonial record clearly shows the warning and the answer given. A statement made by the accused in another case may be used as evidence if the statement record clearly indicates the charge and the answer given.5

As a general rule, in the case of the accused, no question may be asked which

  • includes the answer or instructions for the answer,
  • contains a promise that is incompatible with the law, or
  • involves the statement of an untrue fact.6
