- is or has been involved in the case as a defendant, defence counsel, victim, complainant or their counsel, and their relatives,
- has acted or is acting in the case as a judge, prosecutor or member of the investigating authority’s investigative staff, and their relatives,
- is or has been a witness or witness assistant in the case,
- is the doctor who treated the deceased immediately before death or who established the death cannot be an expert at the time of the examination of the cause and circumstances of death and at the time of the exhumation,
- is an expert of the expert institution,organisation orthe expert panel, if the grounds for exclusion set out in point (a) apply to the head of the expert institution, the organisation or the expert panel,
- is a member of a company, if the ground for disqualification set out in point (a) applies to the manager or officer of the company, or a member or employee of a company whose member or employee has previously been involved in the case,
- was retained as an adviser on the case,
- cannot be expected to provide an unbiased opinion for other reasons.1

The decision to exclude an expert shall be taken by the court, prosecutor’s office or investigating authority. The provisions on the prevention of witnesses from testifying shall apply mutatis mutandis to experts.2
