- in the case of such persons, may be used to prove an offence not specified in the authorisation, provided that the conditions for the use of the instrument laid down in the CPC are also met in respect of the latter offence;
- to prove the offence for which the court has authorised the use of a disguised instrument subject to judicial authorisation, the result of the use may be used against any offender;1
- the result may also be used in relation to the offence of a person not named in the licence, but only in relation to offences involving the intentional taking of another person’s life; kidnapping; offences punishable by imprisonment for up to five years or more, which are punishable under the Criminal Code. Chapter XXIV; terrorist offences; financing terrorism or intentionally causing public danger.2

- it is clear that no results can be expected from further application, including if there is scope for extension, but the necessary data are not available,
- it is clear that the use of the disguised device cannot be continued within the limits of the authorisation,
- the purpose of the authorisation has been achieved,
- the period of validity of the authorisation or extension has expired,
- the application for ex post facto authorisation has been rejected by the court or the prosecution,
- the court revoked the licence or prohibited the use of certain disguised means,
- during the period of application ordered in the preparatory procedure, the time limit for the preparatory procedure has expired and no investigation has been ordered, or
- the proceedings have been terminated or the time limit for the investigation has expired.3
1 However, these rules may only be applied if the body decides to initiate or initiates a preparatory procedure or an investigation in respect of a person or offence not specified in the authorisation within thirty days of the covert instruments ceasing to be subject to a judicial authorisation. The body authorised to use covert means shall inform the court which authorised the use of covert means of this through the public prosecutor’s office. [252 (1)–(4) para.]
