9.6.4. Investigation in private prosecution

The court may order an investigation if the identity, personal data or contact details of the person charged in the private prosecution are unknown, and if it is necessary to search for evidence. For example, the court may order the investigating authority to trace the service provider (in the case of online defamation) or to identify the person by the registration number of his vehicle in the case of slight assault by an unknown offender.

The specific rules of the procedure are:

  • the investigation in this case is usually ordered by the court;
  • the court sends the investigation order and the case file to the investigating authority;
  • the court sets a maximum time limit of two months for the investigation, which it may extend twice, each time by a maximum of two months;
  • the investigation is carried out by the general investigating authority, but it may not terminate or suspend the investigation;
  • the court has the power to supervise the investigation, on the basis of which: (1) the general investigating authority returns the case file to the court after the investigation has been completed; (2) if the identity of the unknown perpetrator could not be established on the basis of the investigation, the general investigating authority informs the court (in which case the court terminates the proceedings); (3) if, during the investigation ordered by the court, the victim withdraws the complaint, the general investigation authority must also return the case file to the court.

If the prosecution has taken over the representation of the prosecution before issuing a summons for a personal interview, it may also order an investigation, which is also governed by these rules.1
