10.2. The prospect of a prosecution measure or decision

This scheme can be seen as a precursor to the use of simplification procedures, as it does not yet entail a direct (positive) legal consequence for the debtor. In essence, it consists of the prosecutor merely informing the suspect of the measure or decision he or she envisages taking in the event of an admission of the offence.1

  1. suspend the proceedings for the purpose of mediation or terminate the proceedings pending the outcome of the mediation,
  2. applyconditional suspension and, depending on the outcome, may terminate the proceedings,
  3. terminate the proceedings or dismiss the charges in view of the suspect’s cooperation; or2
  4. in the event of an indictment, maytake the necessary measures to bring a person before a court and to proceed to a criminal judgment.3

The prosecutor’s office may make the taking of a measure or the issuing of a decision conditional in certain instances on cooperation in the investigation and proof of the case or other criminal case, in other instances on the satisfaction of a civil claim or other obligation to be enforced as notified by the victim.4

During the interrogation, the suspect must be asked to state whether he or she accepts the measure or decision envisaged by the prosecution and its conditions. It is also a rule of guarantee in this context that the suspect’s statement made during the proceedings and the evidence obtained on the basis of it cannot be used as evidence if he or she fully complies with the conditions. However, the prosecution is not obliged to take the measure envisaged and accepted by the suspect or to take a decision if the suspect does not comply with the conditions or makes an untruthful statement.5 The rule supporting incriminating confession is that the suspect and the defence counsel may at any time during the investigation inform the prosecution or the investigating authority that they will make a confession in order to apply the above measure or to obtain a decision.6
