11.2.2. Secondary function of the preparatory meeting: procedure in case of non-admission of guilt

The rules of this procedure apply in the following cases:

  1. the accused did not plead guilty at the preparatory hearing;1
  2. the court refuses to accept the accused’s plea of guilty;
  3. the defendant refuses to answer the question of guilty plea;
  4. the accused has admitted his guilt but has not waived his right to trial in the area covered by the confession.

In such cases, the accused and the defence:

  • may put forward the facts and evidence on which the defence is based,
  • may submit a motion concerning the taking of evidence and other procedural steps, as well as a motion for the exclusion of evidence;
  • the accused may indicate the facts in the indictment which he or she accepts as true.

The defendant and the defence must state individually in these motions the reason for and the purpose of the motion. Accordingly, a motion to exclude evidence must state the reason why the evidence adduced by another is inadmissible, while a motion to admit evidence must state the factual basis for the evidence sought. The prosecutor may comment on the motion of the accused or the defence and may also make a motion (for evidence) and within fifteen days indicate the facts adduced by the accused and the defence which he accepts as true.

The court shall exclude the evidence of its own motion if it is clear from the case file that the use of the evidence would be contrary to the provisions of the Be. If it is not possible to decide on the question of the exclusion of evidence because of the complexity of the case or the content of the case file, the court may examine the evidence proposed for exclusion before ruling. The excluded evidence or the document containing it shall be treated as closed in the case file.

Then, on the basis of the accused’s statement and after hearing the prosecutor’s observations, the court

  • may set the hearing immediately and, if there is no obstacle to holding it, may hold it immediately,
  • determine the scope and extent of the evidence and the order in which it is to be taken, or
  • may disregard evidence in respect of facts accepted as true by the prosecutor, the accused and the defence, and in respect of an offence which, apart from the more serious offence charged, is not relevant to the conviction.2
1 I would note that one can still plead guilty at any time during the proceedings, but it will have less impact on the sentence.
