In the previous chapters we have already touched upon certain specific procedures, but only those linked to the investigative stage (e.g. private prosecution) or the prosecutorial stage (e.g. conciliation). In the present chapter, for reasons of taxonomy, I will deal only with the specific rules governing court proceedings.

As a preliminary remark, it is worth noting that these processes are subject to partially different rules from the general ones, which are justified by the following circumstances:1

  1. Specific characteristics of the suspect: juvenile; military; exempt person; person away or abroad;
  2. Specific characteristics of the accuser: private prosecution and private surrogate prosecution;
  3. Interests in simplifying the procedure: court proceedings, settlement proceedings, proceedings for a criminal conviction, proceedings with the lodging of a security;
  4. The specific subject matter of the case: proceedings for the deprivation of property or goods, making data inaccessible; proceedings for border-related offences.

The specific provisions governing court proceedings can be manifold, as the specificities of the processes are also very different. For example, there may be differences as regards the persons entitled to initiate court proceedings, the purpose of the court proceedings, the content of the charge sheet on which the court proceedings are based, or the means of proof that may be used. Of these special procedures, I will deal only with those which, in the context of the court proceedings, present specific rules of evidence.
