THE THREAT TO THE OZONE LAYER MUST BE ENDED: INTERNATIONAL LEGAL INSTRUMENTS

In the regulatory process of ozone layer protection, four stages can be identified related to the Vienna Convention for the Protection of the Ozone Layer, the Montreal Protocol (VCPO/MP) and its amendments in accordance with the groups of chemicals included therein – that is, when and for which substances the restrictions were introduced in terms of their production, use, and international trade and of course, in order to control/reduce their environmental releases and harms. These stepwise extensions and gradual phase-out provisions were made by taking into account environmental and health considerations, technological possibilities, and economic factors. With some simplification, the beginnings of these periods of the imposition of freon-related targets and obligations were as follows: (i) the adoption of the international convention on ozone layer protection in 1985 and its protocol in 1987, which inter alia addressed the production and consumption of all chlorofluorocarbons (CFC-regulation period); (ii) the extension of the commitments to ‘alternative,’ less ozone-damaging hydrochlorofluorocarbons from 1992 onward (HCFC-regulation period); (iii) the inclusion of emission reduction requirements for the ‘ozone-friendly’ but not ‘climate-friendly’ hydrofluorocarbons, which stage started with the 1997 Kyoto Protocol, the implementation of which was supported by the advisory bodies of the Montreal Protocol (HFC-regulation period in connection with climate change); (iv) from 2016, the responsibility for controlling the production and consumption of the latter substances was taken over by the Parties to the Montreal Protocol through the adoption of a substantial amendment to that legal instrument (HFC-regulation linked to ozone layer protection). Meanwhile, international legal actions against other ozone-depleting materials, such as halons, were also progressing.

Our common planetary home is affected by hazardous environmental processes stemming from human activities. These have gradually reached a global scale during the past century, especially concerning the environmental releases of toxic heavy metals, hazardous chemicals, and waste, the emissions of ozone-depleting substances, and greenhouse gases. All these are directly or indirectly related to the accelerated utilization of a multitude of natural resources and in the broadest sense, to unsustainable production and consumption patterns. These significantly influence the living conditions of present and future generations. The chapters of this book present the emergence, globalization, and escalation of the above-mentioned environmental processes, the history of the recognition of their unintended harmful impacts, the development of the associated international scientific and political cooperation.

The author of this book has been working on this topic for decades, including through his involvement in the work of several international organizations. He has a detailed understanding not only of the natural laws governing planetary environmental processes (that fundamentally determine the life of human societies) but also of the highly complex regulatory affairs concerning human activities that significantly affect the state of the natural environment. Four human-induced environmental problems are explored in this book – their historical antecedents and current situation – which have become particularly critical on a global scale. I recommend this thought-provoking and readable book to those who are interested in the most important environmental problems of our time and the process of their international management.
