A specific concept of French administrative law is public service (Fr. service public),1 which, with some simplification, meant service to the community as a principle. Service public used to mean public service in a similar way to the term fonction publique,2 but today this term is used more often in the sense of public service. In the latter case, its equivalent in German is Daseinsvorsorge, coined by Ernst Forsthoff (1902-1974), which, in addition to public service, also evokes the meaning of the technical terms public good, public security, and public welfare. The most profound scholar of public services was the Frenchman Léon Duguit (1859-1929), and the scientific community he led was called the Bordeaux School (Fr. école de Bordeaux).3

Administrative agreement itself is a product of French law, born during the interventionist public administration of Napoléon Bonaparte (1769-1821, reign: 1804-1814). This era is also known as (?) the ‘acting state’ due to its responses to public service organisation issues. Administrative agreement was influenced by the interpretation of the idea of service public already developed above. According to this concept, the public service organisation activity of the public administration is itself an administrative activity.4 Hungarian legal literature of the time also indicated that by the 1940s, the role of administrative agreements in French law had become increasingly significant.5

In German law, the concept first appeared not under the name of administrative agreements, but under the name of a broader public law contract.6
