8.2.4.3. Amendment and performance of the authority contract

The amendment of the authority contract provides the parties with the possibility of reparation. The reason for this is not only the emergence of a new fact, but also changed circumstances that, if they had existed previously, would have influenced the content of the contract (Lat. clausula rebus sic stantibus). The amendment can be initiated by either party, i.e. the authority, as stated in the rule of the Administrative Procedure Act [Ákr. Section 93 paragraph (1)]. Even if the amendment fails, the path to administrative litigation before the administrative court is open. Although generally only the client is entitled to initiate administrative litigation, due to the contractual nature, this right also applies to the authority. Initiating administrative litigation does not have a suspensive effect on enforcement.1
