Our research is primarily theoretical and exploratory. First of all, it is necessary to make it clear there is no overall theoretical monograph in Hungary on this topic. Because of these abovementioned scientific problems, our goal has been to seek out the wider historical backgrounds of the problem. This research applied traditional methods of legal science and administrative sciences: searching and reading legal and administrative literature in several languages, and studying relevant laws and legal regulations, the legal practice of different courts and tribunals in Hungary and in other jurisdictions within and outside the EU. We found that the application of empirical methods does not necessarily yield to appreciable results. Furthermore, it is necessary to take into account certain related results of environmental science and economics.
