Extensive legislative processes have begun in most States to implement a sustainable construction economy at the Member State level. These are embodied in the adoption of primary central-level normative and other non-binding legal acts - mainly strategies, plans and recommendations. Central regulators are supplemented by a system of local level regulators in accordance with local characteristics. In addition, many settlement-level regulators formulate local-level sustainability rules among settlement development regulators, especially in line with the concept of sustainable settlement planning1 and the smart city.2 The OECD also stated in its report (referenced earlier)3 that the regulators of the countries examined primarily focus on energy-related measures and pay less attention to the examination of the entire life cycle from the point of view of sustainable buildings. Most of the responding countries have introduced mandatory energy efficiency codes, primarily for insulation and preferring the green retrofit method. In addition, for new buildings, most new regulators have already begun to accept near-zero standards as the new norm. E.g. in Japan, by 2050, all buildings aim for net zero energy efficiency. To this end, standards are set for each type of building (e.g. for non-residential buildings) and in July 2022 the country revised its law on the energy conservation of buildings in order to meet the energy efficiency standards of buildings by 2025.

France, the Netherlands, Norway and Sweden have introduced lifetime carbon reduction rules. Regarding the management of climate change, the OECD survey highlights that a quarter of the countries have regulations for extreme temperatures, and a fifth have flood protection regulations. At the same time, countries widely use international sustainable building certification standards, especially Energy Performance Certificate (abbr. EPC), Leadership in Energy and Environmental Design (abbr. LEED) and Building Research Establishment Environmental Assessment Method (abbr. BREEAM) labels.

A drastic expansion of the current building stock is expected in India. In December 2022, the Indian legislature passed an amendment to the Energy Conservation Act, which sets the parameters of a carbon trading scheme and enables the definition of energy saving and sustainable building rules for large buildings.4 In addition, here too, the gaps in the regulations and the lack of incentives limit the greater spread of sustainable construction.5

China’s latest Building Energy Code sets mandatory energy efficiency standards for new constructions and building renovations and extensions. In addition, mass migration from rural areas to urban areas has taken place in China, which has necessitated the formulation of regulations for the rapid establishment of residential buildings. Thanks to this, the regulation of modular architecture, which has many advantages from a sustainability point of view, is increasingly coming to the fore.6

In addition, quite a few countries have also introduced green building regulations corresponding to local specificities: for example, in order to combat the urban heat island effect, Tokyo has required newly built, renovated or expanded private facilities above the size of the legally defined area to provide green cover.7 The recently updated California 2022 Building Energy Efficiency Standards encourage the use of efficient electric heat pumps.8

Article XXI of the Fundamental Law of Hungary10 recognises and enforces everyone’s right to a healthy environment. In connection with this, the Fundamental Law also states that whoever causes damage to the environment is obliged to restore it - as defined by law - or bear the cost of the restoration. Furthermore, it is forbidden to bring polluting waste into the territory of Hungary for the purpose of disposal. Based on Act XXII. of the Fundamental Law, the State grants legal protection to the home. Hungary strives to ensure decent living conditions and access to public services for everyone. The state and local governments also help to create the conditions for decent housing and to protect the use of public space by striving to provide accommodation for all homeless people. The practical implementation of these rules is supported by sector-level legislation and local-level regulators. Pursuant to Article 32 of the Fundamental Law, acting within the scope of its duties, the local government creates a decree for the settlement of local social relations not regulated by law, or on the basis of an authorisation granted by law. Consequently, local governments have the right to create broad legislation in the field of construction law as well.

The issuance of central regulations regarding certain areas of construction appears under the jurisdiction of several ministries. Currently, the Minister of Construction and Transport is responsible for construction regulation, settlement development and settlement planning, and the protection of settlement image. At the same time, the minister in charge of the Prime Minister’s Office is responsible for the enforcement of sustainability aspects in relation to individual commercial buildings, as well as for matters related to rust zone action areas.11 The various building supervision and construction licensing powers are divided between several authorities, and the process of building authority procedures is quite complex, requiring the cooperation of several specialised administrations and other administrative bodies.

settlement planning and architectural-technical planning must promote the strengthening of the local economy, local communities, local identity and the local labour market.

within the framework of the principle of preservation of natural systems, the natural environment and its level of protection must be respected during settlement planning, the worthy utilisation of architectural heritage and the placement of new buildings. During planning, special attention must be paid to the preservation of landscape character and to the improvement of the quality and connectivity of green infrastructure elements. During architectural and technical planning and construction activities, efforts must be made to maintain the existing plant population and to use products with the green trademark.

in the case of areas intended for new construction, the law requires that the green area should not decrease overall within the administrative area of the settlement;

keeping a separate record of brownfield areas;

during the construction process, special attention must be paid to ensure that the structure and landscape design provide the highest possible quality of life and functionality consistent with their purpose;

based on the principle of security of domestic supply, the main goal in the production and marketing of building materials, plant materials and construction products is that the supply should exceed the demand, and in case of a shortage, Hungarian substitute construction materials and plant materials should be available;

during settlement planning, construction and heritage protection official procedures, as well as the construction process, the state must implement its procedural, documentation and record-keeping, as well as other administrative tasks electronically.

In Hungary, from January 1, 2021, Act LVII of 2015 on energy efficiency introduced the energy efficiency obligation system, an obligation based on energy efficiency improvement investments operating on a market basis, and new alternative energy efficiency policy measures were also recorded, the planning and continuous monitoring of which is only possible on the basis of modern indicators in order to continuously achieve the EU targets. The certification of the energetic characteristics of buildings is determined by government decree 176/2008 (VI. 30.). Based on the decree, the certificate must be issued for the building as a whole.

On the certificate, the building envelope structures and building technical systems that are relevant from an energy point of view must be classified according to efficiency for each purpose of use.12

A sectoral ministerial decree defines the rules for determining the energy characteristics of buildings.13 One of the cornerstones of the new legislation adopted in 2023 is that the requirement of a mandatory renewable energy share will be abolished as a requirement for near-zero energy demand for new buildings, and it will be replaced by the requirement of a mandatory upper limit of specific carbon dioxide emissions. In addition to maintaining the overall energy characteristic, the decree stipulates the establishment of the upper limit of specific carbon dioxide emissions based on the entire life cycle as a requirement level for new buildings. By determining the weighting factors for carbon dioxide emissions, this solution makes (efficient) district heating and district cooling from waste heat or combined energy equivalent to renewable energy and also provides flexibility for builders.

Finally, it is also worth mentioning the Hungarian ESG Act that entered into force in the summer of 2024.14 According to the new law, the register of the ESG report published by the company must be public, its content can be read and viewed by anyone without restriction. Based on the principle of double materiality, businesses disclose appropriate information about their sustainability risks and opportunities, as well as their impact on people and the environment. In addition, the law stipulates, among other things, that the company must take long-term sustainability opportunities into account in order to enforce the principle of environmental sustainability during its business activities, and ensures that they are implemented in its business strategy. In addition, in accordance with the principle of social responsibility, the company examines and manages the social and environmental effects of its operations during its business activities and takes a role in promoting the values laid down in the Fundamental Law, especially family-friendly operations. The law also lays down the detailed rules for how the company can prevent or minimise social responsibility or environmental risks in its supply chains in accordance with the social responsibility and environmental due diligence requirements or eliminate violations of social responsibility or environmental protection obligations. According to the law, the company fulfils its obligations by preparing an annual ESG report on the fulfilment of its due diligence obligations for the purpose of sustainability for the previous business year, which must be audited by an ESG certifier.
