the history of secular morals,1 the Evangelical theology,2 as well as Roman Catholic Church law (canon law),3 the findings of Roman law, 4 the prehistory,5 the ethnography, and legal ethnology/law anthropology.6. The statements of Karl Marx (1818-1883) and Vladimir Il’ič Lenin (1870-1924)7 are also discussed, since the onerous intellectual heritage of scientific socialism cannot be ignored, given the spreading neo-Marxist views and the Marxist renaissance that is emerging in Western Europe and North America. Methodologically, it has been a well-known fact in jurisprudence since the 1846 monograph of Karl Theodor Pütter (1803-1873)8 that the source material (historical sources, legal sources, documents) from which the rights and primitive legal systems of individual ancient states (Ger.: Urstaat) could be reconstructed is lacking. He considers works that seek to describe the customs and morals of ancient peoples as sources in order to learn about ancient law. Pütter mentions the Eastern natural states (Ger. morgenländische Naturstaaten) and the Western free states (Ger. abendländische Freistaaten) as an initial typology. At the same time, he also indicates that the teachings of Georg Hegel (1770-1831)9 dominated the establishment of the concepts of law and the state. In addition to the aforementioned Urrecht, Naturstaat, and Freistaat, the conceptual scale extending from the concept of human rights (Ger. mensliches Recht) to Christian rights (Ger. christliches Recht) and the ‘freer’ state (Ger. freier Staat) is a reflection of his teachings.10

Before we examine the origin and development of marriage, family, private property, or the state in more detail, it is necessary, due to the frequently appearing religious questions that accompany the subjects under consideration, to explore what religion is and how it came into being. An exact historical answer to this question cannot be given; generally speaking, two views may be distinguished: the opinions of secular social scientists, who are often atheists, and the responses of theologians who are themselves believers. (The ideas of religious scholarswhose beliefs fluctuate between faith and atheism are not discussed in this sub-chapter.) Among secular social scientists, the skeptical atheistic attitude appeared early in Hungary, as typified by the example cited from the beginning of the 20th century, which perceives anti-religion as freedom and doubt as a source of joy, but in a way that points out that there are many life situations in which neither law, custom, morality, religion, nor the atheistic worldview serve as guidance.11 The same author traces the birth of religion back to the fear of death.12

As society became organised, it also sanctioned certain religious institutions. The centre of religious institutions was a supreme being, who was first vengeful, then benevolent. He was honoured with propitiatory and then supplicatory sacrifices.13 Polytheism also developed. Giving the secret power a name gave rise to deities. (Along with the veneration of kings, chiefs, and animal cults).14

Older moral history also addresses the specific changes in belief in the Renaissance, such as the intensification of belief in witches and the devil.15 According to the other theological answer, when evaluating religious phenomena, one must take into account the fundamental concepts that profoundly influence human life and environment (such as language, tools, institutions). The entities traditionally called ‘religion’ and ‘god’ are so closely linked to so many expressions of culture that separating the empirical and metaphysical spheres is very difficult.16 On the other hand, in the case of primitive religions, religion is linked to ignorance and fear. In advanced religions, there is the belief that the wonderful world must have been created by an infinitely powerful Being, or that He must have directed creation. In more refined religions, fear is replaced by the dominant emotion of gratitude, admiration, and praise.17

A specific institution in church history was the Roman Index (Lat. Index librorum prohibitorum), which prohibited inappropriate reading and was published for more than four centuries, between 1559 and 1966.18
