9.5. Investigation II: the examining

Examining is a procedure aimed at analysing and evaluating the evidence uncovered during detection, the aim of which is twofold: to fully (preliminarily) investigate the known offence and to establish the personal circumstances of the known offender. Since at this stage of the procedure there is already a well-founded suspicion of a criminal offence, decisions on the further course of the procedure can be prepared. Accordingly, the investigating authority will examine the possibilities of (1) establishing the conditions for indictment, (2) using “simplified” procedures, or (3) terminating the proceedings. The “examining” thus implies that the prosecutor does not yet take a decision on these matters,1 but only carries out an evidentiary activity to establish the conditions for the application of the procedural options provided for by the CPC.   • prospect of a prosecution measure or decision,
  • initiating a settlement,
  • the suspension of proceedings for the purpose of mediation,
  • a conditional suspension of the prosecution,
  • the suspension of proceedings for any other reason,
  • the termination of the procedure,
  • an indictment,
  • the performance of a procedural act within the framework of the investigation, or
  • separation, merger or transfer.2
