e) Certain issues relating to the transfer of contract

The general rules apply to the conclusion of the contract.1 These rules are only somewhat complicated by the fact that the provisions of the BGB, which are typically formulated for bilateral legal relationships, apply in the case of a transfer of a contract in a tripartite legal relationship, depending on the contractual structure chosen. This does not pose any particular problems as regards the making and validity of declarations. What concerns the effectiveness of the declarations, in view of the fact that there are two addressees, it is necessary to examine whether the declaration has taken effect in respect of both addressees.2
