Transfer of contract in the case law of the 1959 Civil Code

Although the 1959 Civil Code did not contain rules on the transfer of contracts, in the early 2000s, presumably as a result of the drafts of the Civil Code that contained rules on the transfer of contracts were published,1 several judgments have appeared in the case law that recognised the transfer of contract by a tripartite agreement. (As already mentioned, the possibility of transfer of contract on the basis of statutory rules was recognised both in the Civil Code and in several other legal norms.)
