Transfer of lease rights in practice: transfer of rights or transfer of contract?

In the years following 1989, when Hungary transformed from a command economy to a market economy, the transfer of lease rights was often used in practice.1 In such cases, the tenant transferred his rights under the lease, in a way that the obligations also transferred to the new tenant. In essence, therefore, the parties have created a succession in the position of tenant of the lease.
