a) The white paper of the Civil Code

In response to the needs of the practice, already the white paper of the Civil Code1 took a position in favour of strengthening the institution of transfer of contract (in the terminology of the white paper: contract assignment). The white paper stated as a starting point, that “[t]he conceptual framework of assignment must be adapted to the new phenomena and economic functions that have emerged in commercial (business) transactions. The needs of commercial transactions require assignment to be used for purposes that go beyond the original model of the Civil Code in several respects. The new Civil Code must meet these requirements.”2
