d) A new motion to the Constitutional Court

Considering that the legislator did not remedy the omission found by the Constitutional Court and no uniform court practice has developed on the issue, in March 2021, the Győr Regional Court of Appeal turned again to the Constitutional Court in connection with Section 53/C of the Act on Transition. According to the motion of the court, Section 53/C (1) and (2) of the Act on Transition violate Articles B) (1), C) (1), XIII (1), XXVIII (1) and 24 (1) of the Fundamental Law.1 The provisions listed by the court concerns, among others, the rule of law, the separation of powers, right to property, right to a fair trial.
