Between whom do the legal relationships exist?

Although the explanatory notes to the pre-World War II draft civil codes considered it evident that a change of party could also take the form of a novation, the above-mentioned concerns about the amendment of a contract also arise in the case of a novation. It is not clear how A and B can novate their contract in such a way as to create a legal relationship between A and C. A further issue, although one that can be resolved by contract given the default nature of the legislation, is how the contract between A and B can be terminated without there being a settlement of accounts.
