Sustainability1 has been woven into the Constitution of Hungary through the Fundamental Law (2011), but the three instances are not related to environment, but rather focus on other issues: (i) article N establishes sustainable budget management; while (ii) Article Q establishes the goal of Hungary’s international co-operation to be peaceful co-existence, and indeed sustainable development of humanity; finally (iii) in relation to the labour market, the cooperation between employees and employers for the sustainability of the national economy. So, Article P and Article XXI envisages the nation’s natural resources and biodiversity to be a national ecologic heritage held by the nation, and therefore healthy environment should be protected.

Article N) (1) Hungary shall observe the principle of balanced, transparent and sustainable budget management
Article Q) (1) In order to create and maintain peace and security, and to achieve the sustainable development of humanity, Hungary shall strive for cooperation with all the peoples and countries of the world.
Article XVII (1) Employees and employers shall cooperate with each other with a view to ensuring jobs and the sustainability of the national economy, and to other community goals.
Article P) (1) Natural resources, in particular arable land, forests and the reserves of water; biodiversity, in particular native plant and animal species; and cultural artefacts, shall form the common heritage of the nation, it shall be the obligation of the State and everyone to protect and maintain them, and to preserve them for future generations. (2) The limits and conditions for acquisition of ownership and for use of arable land and forests that are necessary for achieving the objectives referred to in paragraph (1), as well as the rules concerning the organisation of integrated agricultural production and concerning family farms and other agricultural holdings, shall be laid down in a cardinal Act.
Article XXI (1) Hungary shall recognise and endorse the right of everyone to a healthy environment. (2) Anyone who causes damage to the environment shall be obliged to restore it or to bear the costs of restoration, as provided for by an Act. (3) The transport of pollutant waste into the territory of Hungary for the purpose of disposal shall be prohibited

Many other provisions in the Fundamental law connect sustainability to labour relations, defence and welfare, with sustainable development promoted through the establishment of cooperative economic development, the sustainable management of cultural and natural heritage, and also through the framing of international law and sustainable development goals in public policy (Article XVII, XIX, 45-49).

Whitin the government, for the ministers the 182/2022. (V. 24.) Government Decree on the duties and powers of the members of the Government set the competences.2 The Minister Heading the Prime Minister’s Office is responsible for the enforcement of sustainability aspects in relation to certain commercial buildings, monitor the sustainability of urban planning,3 as well as economic and social processes related to commercial buildings subject to licensing. The Minister of Agriculture has direct responsibility for agricultural policy, rural development, food chain and industry, forestry, land affairs, fish farming, water management, nature and game conservation, while being explicitly for the sustainable management practices of managed forests. The Minister of National Economy prepares economic policy proposals for the Government, which are aimed at improving balance, sustainably increasing economic growth. The Minister of Energy has responsibility for developing policies on the circular economy and energy efficiency, and their policies are designed to make Hungary’s economic development more comparable to the sustainability benchmarks of internationally accepted norms.

Beyond the declaration of fundamental rights and duties for the individuals and the state at a constitutional level, other laws provide a detailed breakdown on further aspects of sustainability. Act CCXI of 2011 on the Protection of Families states that the birth of children and the growth of families are essential for sustainable development and economic growth.4 The law emphasises that having children should not lead to the impoverishment of families. The operation and sustainability of civil society organisations is regulated by Act CLXXV of 2011, which establishes community service centres for the professional support of civil society organisations and the use of regular support, which also strengthen sustainability (Sec. 51).5 Act X of 2006 on cooperatives highlights that they play an important role in promoting economic, social, environmental and cultural sustainability.6 Act XCIII of 2021 on the Coordination of Defence and Security Activities states that the preparation of the national economy for defence purposes ensures the sustainability of the supply of the population and the operation of the economy in the event of crisis situations, in cooperation with the state and economic actors.7 However, the law states that certain prescribed reserve requirements may not be required if they would jeopardise the sustainable operation of the obligor (Sec. 28). Act LIII of 1995 on the general rules for environmental protection provides a comprehensive legal framework for environmental protection, highlighting the importance of sustainable development.8 Act LIII of 1996 on Nature Protection provides a comprehensive framework for the protection of natural values and areas, with particular regard to the conservation of biodiversity and ensuring sustainable utilisation.9
