c) The doctrine of transfer of contract

In the absence of an explicit rule in the BGB, the courts derive the possibility of the transfer of contract from the principle of freedom of contract.1 Although § 311 (1) of the BGB refers to a contract, i.e. a legal transaction that is created by the unanimous declaration of intent of two parties, the legal literature unanimously recognises that the principle of freedom of contract applies mutatis mutandis to multi-subject legal relationships, including tripartite transfers of contract.2
