Transfer of contract and the assignment of future claims

In the legal literature, there was a dispute over how the transfer of a contract affects the assignment of future claims arising from legal relationships that do not exist at the time of the transfer (Vorausabtretung).1 The difficulty lies in the fact that the claim does not exist at the time of the transfer of contract, but when the claim is created, the transferor is no longer the holder of the claim and cannot dispose of it.
