Legal and Broader Impacts of the War in Ukraine on Hungary and Poland


State-organized assistance

The general legal basis of providing assistance to Ukrainian citizens who have arrived in Poland in connection with the hostilities is contained in Article 12 of the Special Act. Based on that, the voivode, who is the representative of the Council of Ministers in the voivodship,1 may, from February 24, 2022 (Article 98(1) of the Special Act), provide refugees with, among other things, housing (Article 12(1) of the Special Act); in addition, it may provide food, transportation, medical assistance and “take other measures necessary for the implementation of assistance”. The same assistance may also be provided by, among others, public administration bodies and local government units (cf. Articles 12(3), (4), (18) and (19) of the Special Act), and may be commissioned for implementation by non-governmental organizations (cf. Article 12(8) of the Special Act). The regulations grant wide-ranging flexibility as to the form and scope of the assistance to be provided, and exclude the obligation to apply the provisions on public procurement (Article 12(6) of the Special Act). The doctrine points out that Article 12 of the Special Act has a “broad impact” (Martyniuk-Placha & Muszyńska, 2022), and that “the final decision on the granting of assistance, its scope or its organization rests with the voivode” (Princ, 2022). This solution seems reasonable, since in an extraordinary situation it was necessary to leave it to the authorities to select such measures that were both necessary and feasible under the given conditions.2 A key role in this process is played by the voivode, whose task is to coordinate the activities of public authorities, non-governmental organizations and entrepreneurs in providing assistance to Ukrainian citizens (Article 12(2) of the Special Act). In this regard, the voivode has been authorized to issue orders (in the form of administrative decisions) binding on all government administration bodies operating in the voivodship area, state legal entities, local government bodies, local government legal entities and local government organizational units without legal personalities in connection with the implementation of assistance tasks (Article 12(10) of the Special Act3).
