Legal and Broader Impacts of the War in Ukraine on Hungary and Poland


The eligibility and rights granted under the Directive

The mechanism established by the Directive applies to mass influx of ‘displaced persons’. This category is defined by the Directive, which provides a general framework for eligibility conditions (general eligibility criteria). According to this definition,1 eligible persons include third-country nationals or stateless persons who have been forced to leave their country or region of origin, or have been evacuated, particularly in response to an appeal by international organisations. Such individuals are unable to return in safe and durable conditions due to the prevailing situation in their country. Refugees within the meaning of the 1951 Refugee Convention2 or under other international or national instruments providing international protection are eligible, particularly those who have fled areas of armed conflict or endemic violence, or those at serious risk of, or who have been victims of, systematic or generalised violations of their human rights. Thus, while the Directive potentially defines the scope of eligible persons very broadly, the actual scope has been specified by the decision activating the temporary protection (specific eligibility criteria).
