Conclusion

The EU’s Temporary Protection Directive was applied for the first time, despite the fact that the conditions for ‘qualification’ set out in the Directive were already in place during the 2015 refugee crisis. However, during the present crisis triggered by the Russian invasion of Ukraine in 2022, the Directive was employed as a crisis management instrument. This resulted in refugees from Ukraine being granted a series of rights that are not available to asylum seekers under the conventional asylum procedure, which entails fewer rights and more obligations. In conclusion, the overall assessment is that the objective of establishing temporary protection – namely, the more efficient regularisation of the status of refugees and their more successful integration into the socio-economic space – has been achieved.
