Legal and Broader Impacts of the War in Ukraine on Hungary and Poland


Conclusions

The above-described changes in the provisions regulating the status of persons benefiting from protection due to the need to leave the territory of Ukraine as a result of the armed conflict reflect the apparent intention of the Polish legislator to slowly extinguish the extraordinary solutions provided for in the Special Act. The primary mode of change is to replace the temporary protection UKR with various kinds of temporary residence permits (including temporary residence permits for the purpose of taking up employment, for the purpose of working in a highly qualified occupation or for the purpose of carrying out business activities and the possibility of obtaining a residence card in accordance with the amendment that came into force on 1 July 2024). At the same time, it is worth remembering that persons covered by the scope of the Special Act still have the possibility of applying for international protection, pursuant to the provisions of Section II of the Act on granting protection to foreigners, i.e. for refugee status. Against the background of the legislator’s intentions thus identified, one may be tempted to draw two conclusions.
