Legal and Broader Impacts of the War in Ukraine on Hungary and Poland


Introduction

The legal framework of Ukraine does not encompass the prohibition of dual nationality in general. The Constitution, however, does stipulate the principle of single nationality, thereby indicating a stance that does not necessarily prohibit dual nationality. This raises a number of questions. If Ukrainian nationals acquire an additional nationality, does this action result in the automatic loss of their Ukrainian nationality? If foreigners acquire Ukrainian nationality, must they renounce their previous nationality? Can children eligible for multiple nationalities at birth become dual or multiple nationals? Additionally, the implications of Ukraine’s dual nationality policy on military obligations, as well as its influence on the acquisition of citizenship by refugees in other states, warrant examination. In the preceding year, there have been indications that Ukraine is modifying its approach. At the beginning of 2024, the President proposed amending the law to recognise dual nationality. Another amendment was adopted during the summer, which stipulates that Ukrainian men who possess dual nationality are prohibited from departing Ukraine because of military obligations, even if they are habitually resident in another state and are only visiting Ukraine for a brief period. In December 2024, Parliament also adopted an amendment that would allow dual nationality. The legislative framework of Ukraine is also influenced by the 1997 European Convention on Nationality and the 1951 Refugee Convention and its 1967 Protocol, to which Ukraine is a state party. The nationality regulation of Ukraine also impacts its relations with other states; therefore, the study also discusses the interaction between Hungarian and Ukrainian nationality regulations.
