Legal and Broader Impacts of the War in Ukraine on Hungary and Poland


Preparations for the reception of refugees

Since the turn of 2013, in connection with the crisis in Ukraine, followed by the armed conflict in Donbas and the annexation of Crimea, Polish authorities began to prepare for the possibility of a significant influx of Ukrainian citizens to Poland. At the level of the interior minister (together with the Border Guard and the Office for Foreigners), plans were drawn up for this eventuality. The basic planning document for emergency situations is the National Crisis Management Plan adopted by the Council of Ministers, based on the Act of April 26, 2007 on crisis management (last updated on March 3, 2022). It contains, among other things, procedure SOP-9 (part B, pp. 114–127), which specifies actions in the event of a mass influx of foreigners into the territory of the Republic of Poland, without specifying the direction of the influx. This procedure identifies the coordinator and participants in activities related to the influx of foreigners, as well as their course (undertakings, the manner of performing tasks, responsible entities and task performers), divided into stage I (organization of central reception points, centers for foreigners and encampments) and stage II (organization of further stay of foreigners in the country). As part of stage I, it was assumed that, firstly, centers for foreigners administered by the Head of the Office for Foreigners and facilities acquired by him would be used to provide foreigners with accommodation (within the framework of this undertaking, the availability of places in centers for foreigners should be verified, additional centers for accommodation should be prepared for launch, and accommodation and food should be provided in each center). Then, the minister responsible for public administration is to apply to voivodes for the selection of facilities to be used as central reception points or centers for foreigners, and the designated voivodes are to prepare additional accommodation for foreigners (the selection of facilities should be done in cooperation with local government bodies, and dormitories, resorts, training centers, hostels, hotels, etc. should be considered as potential facilities). The activation of the facilities selected by the voivodes depends on the decision of the Head of the Office for Foreigners, whose representative is responsible for the operation of the facility. In view of the continued influx of foreigners and the lack of places in the selected permanent facilities, the SOP-9 procedure provides for the organization of temporary encampments (accommodation would be in tents and residential containers). However, temporary encampments may be established as a last resort, when all other permanent accommodation resources have been exhausted. In stage II, sites for the reception of foreigners should be selected, if this was not done at the previous stage, as well as, if necessary, applications to EU Member States for the transfer of beneficiaries of protection from Poland to another EU Member State.
