Legal and Broader Impacts of the War in Ukraine on Hungary and Poland


State support for those providing accommodation to refugees

Polish society has been actively involved in assisting the citizens of Ukraine. During the first two months of the war, 28,600 nonprofit organizations (29.8% of all nonprofit organizations) were involved in providing various types of assistance (Statistics Poland, 2022a, p. 1) and in the first six months of 2022, more than 70% of Polish households provided assistance to residents of war-stricken Ukraine (Statistics Poland, 2022b, p. 1). Without the grassroots, selfless activism of a large group of ordinary people, particularly in the first weeks of the war in Ukraine, the state would probably not have been able to meet the needs of all the refugees (Polish Economic Institute, 2022, p. 23). People provided monetary and in-kind assistance and even welcomed refugees into their homes. Recognizing this activity, the legislature introduced a mechanism for subsidizing the accommodation of Ukrainians in private houses and other private facilities (e.g., hotels, empty apartments). According to Article 13(1) of the Special Act, any entity, in particular a natural person providing for a household that offered accommodation and food for Ukrainian citizens at their own expense could request a cash benefit. The benefit period was 120 days from the date of the Ukrainian citizen’s arrival in Poland, although it could be extended in particularly justified cases. In a regulation, the maximum amount of the cash benefit, as well as the conditions for granting and extending it, were delegated to the Council of Ministers for determination (Article 13(3) of the Special Act).
