Legal and Broader Impacts of the War in Ukraine on Hungary and Poland


Conclusions

The war in Ukraine has had a profound impact on Poland, prompting the implementation of unprecedented measures to address the massive influx of foreigners. The breakthrough came with the entry into force of the Special Act establishing rules for the provision of assistance by public entities. A key role was given to the voivodes, who were charged with providing all types of assistance and, in the first place, accommodation. Significant funds were allocated for this purpose. The biggest challenge, however, was to prepare adequate living conditions for thousands of people very quickly. To achieve this, the voivodes were equipped with a wide range of legal instruments, including issuing binding orders and concluding contracts for the provision of accommodation. A considerable part of Polish society also became involved in the assistance by inviting refugees into their own homes. In turn, those providing shelter could count on the state to cover part of the hospitality costs. With great effort, the Polish state and society thus created a legal and organizational framework for providing accommodation to Ukrainian citizens, which also fulfilled the requirements of EU law (Article 13(1) of Directive 2001/55/EC). Refugees who did not require direct assistance in obtaining accommodation were also able to expect state assistance, including material assistance. It is noteworthy that the legislator introduced a number of extraordinary solutions to facilitate housing assistance. Despite numerous legal and practical challenges, Poland has managed the accommodation of refugees from its eastern border remarkably well. The solutions adopted in this context may serve as a model for addressing future instances of mass foreign arrivals.
