Legal and Broader Impacts of the War in Ukraine on Hungary and Poland

In the field of secondary legislation, sector-specific regulations that implement fundamental rights frequently encompass more detailed provisions concerning the development or utilisation of novel technologies. In the present case, the relevant legislation includes Directive 2016/680 of the European Parliament and of the Council (EU) on Law Enforcement (LED) (European Parliament and Council, 2016a), Regulation (EU) 2016/679 of the European Parliament and of the Council on Data Protection (GDPR) (European Parliament and Council, 2016c), and the AI Act, which also contains requirements for facial recognition systems. A significant concern regarding the utilisation of facial recognition technology by law enforcement agencies pertains to the interoperable exchange of biometric data among these agencies on an international scale. The exchange of such data within the context of police and judicial cooperation in criminal matters within the European Union is governed by the LED. The LED, thus, constitutes an EU law that is analogous to the GDPR, addressing the processing of personal data by data controllers for law enforcement purposes, which fall outside the purview of the GDPR.
